<p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">On Friday, the European Commission announced its first enforcement action under the platform-regulating Digital Services Act. The commission fined X €120 million, or about $140 million, for violating rules related to ad transparency, data access for researchers, and its paid verification system. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In response, less than two days later, X's head of product said that the company had banned the commission from advertising on the platform.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">"Your ad account has been terminated," Bier <a href="https://www.platformer.news/r/deefceed?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">posted</a> early Sunday. He said the commission had exploited X's ad tools to make its post about the fine look like a video and "artificially increase its reach." Bier went on: "X believes everyone should have an equal voice on our platform. However, it seems you believe that the rules should not apply to your account."</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Bier's bratty retaliation appeared more like a bid to win a high five from his boss, X owner Elon Musk, than it did an effort to shore up the integrity of his platform. But in banning the commission's account on the faintest of pretexts, Bier also demonstrated why the Europeans had begun investigating X to begin with. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Bier's chest-thumping rationale for enforcing platform rules collapsed under scrutiny. The idea that X is a platform where all voices are equal is belied by the fact that you can promote your posts ahead of anyone else's by advertising them, just as the commission had, or by becoming a paid subscriber. And the suggestion that the commission was running some sort of scam rested on Bier's vague assertion that it had found an "exploit" by mislabeling one sort of post as another. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">More to the point, and to the letter of the DSA law: there was no appeal process, no transparency about how similar cases are handled, and no explanation of why this particular post merited account termination rather than, say, removal of the offending content. (Platforms typically go out of their way to retain advertisers who have done far worse than what the commission is accused of here. How else do you think <a href="https://www.platformer.news/r/87079f42?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">Meta estimates</a> that it makes $7 billion a year from scam ads?)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In any case, all this is exactly the sort of capricious and opaque platform power the DSA is designed to check. The law, which took effect last year, requires large online platforms to disclose how they moderate content and enforce their rules. It also mandates access to data for researchers who are studying platform harms. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The commission's case against X named three key offenses. First, there's the company's <a href="https://www.platformer.news/r/f3ed8526?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">notoriously deceptive</a> "verification" system. Once a signal that an account is owned by the person it purports to be, blue checkmarks on X now simply indicate that someone has paid for a subscription. The commission, which first signaled that it found this problematic <a href="https://www.platformer.news/r/fa153326?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">two years ago</a>, argued that X verification "deceives users" by not "meaningfully verifying" account holders, and further exposes them to impersonation scams. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Second, the commission found that X does not maintain a proper ad library. (<a href="https://www.platformer.news/r/d6bbf869?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">It exists</a>, but so far as I can tell, it doesn't work.) And third, the company has failed to provide researchers with access to public data, as the law requires.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Notably, none of these violations involve the content of posts on X. But that distinction has been lost in the response from Trump administration officials, who insisted that the fine represents an effort to censor American voices.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Before the fine was even announced, Vice President JD Vance attacked the Commission on X. "Rumors swirling that the EU commission will fine X hundreds of millions of dollars for not engaging in censorship," he <a href="https://www.platformer.news/r/39602e40?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">wrote on Thursday</a>. "The EU should be supporting free speech not attacking American companies over garbage."</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">After the fine, Secretary of State Marco Rubio <a href="https://www.platformer.news/r/56ab7236?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">piled on</a>. "The European Commission's $140 million fine isn't just an attack on @X, it's an attack on all American tech platforms and the American people by foreign governments," he wrote. "The days of censoring Americans online are over."</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Switching things up a bit, FCC Chairman Brendan Carr <a href="https://www.platformer.news/r/4915299d?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">said that</a> "Europe is fining a successful U.S. tech company for being a successful U.S. tech company." This marked perhaps the first time that X has been described as a successful tech company.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But the truly crazy-making thing about US officials' response is that the DSA, properly enforced, should <em>reduce</em> the amount of censorship online. It requires platforms to tell you which specific rule you broke before removing your post, and to allow you to appeal if you believe they got it wrong. It also forces platforms to post their content moderation decisions into a public database, creating what is essentially a real-time feed of what is being erased from the internet.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The spotlight that this places on the content moderation decisions of platforms like X should actually encourage them to moderate <em>less</em> content, for fear of false positives, spiking user appeals, and the resulting public-relations and regulatory crises that they might cause.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But US officials are not reckoning with the law as it is actually written. They are responding with indignation to the idea that the European Union has any sway over US platforms at all. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">On one level, the cries of "censorship" are absurd. But they also seem to be having their effect. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">After spending the entirety of his first term complaining that tech companies were biased against them, President Trump emerged this year <a href="https://www.platformer.news/r/8da27d7d?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">as their vocal champion</a>. His administration has aggressively criticized European tech regulations as overbroad, even going so far as to say <a href="https://www.platformer.news/r/b5f3d489?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">it might sanction</a> EU officials who enforce them. More recently, Commerce Secretary Howard Lutnick threatened to maintain 50 percent tariffs on European steel and aluminum <a href="https://www.platformer.news/r/53127871?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">unless the EU loosens its digital rules</a>.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">It's difficult to overstate how significant this shift is. For more than two decades, platform behavior has been governed by the so-called <a href="https://www.platformer.news/r/ce66332e?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">Brussels effect</a> — the spread of European Union regulations beyond its borders, as companies calculate that it will be easier to adhere to a single, more stringent set of rules than to create different versions of their platforms for every country. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The Brussels effect has its annoyances — those cookie pop-ups you see on every website, for starters. But it is also the reason that you can download your data from Google, Apple, and other platforms; the reason you can now request the deletion of your data on many platforms even if you don't live in the EU; and that you can now charge your iPhone with a USB-C cable.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The Brussels effect has depended on American acquiescence. But Trump has now made it clear that he intends to fight it.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">And the EU has already begun to succumb to the pressure. It is looking to <a href="https://www.platformer.news/r/36b592d9?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">scale back privacy and AI regulations</a>. And member states are <a href="https://www.platformer.news/r/fd1ab1fd?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">giving up on digital service taxes</a> to curry favor with the Trump administration.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The question now is how — beyond terminating an ad account — X will respond. The company has 60 to 90 days to propose compliance measures, or it may face additional penalties. Whether those penalties ever materialize, and whether X bothers to comply at all, will tell us a great deal about the current state of the Brussels effect.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Ever since I've been writing a newsletter, tech regulation has been something that happens primarily in Europe. Thanks to a coordinated campaign by the tech industry and US officials, that period may be coming to an end. Not every dimension of the Brussels effect was positive. First, a draft executive order from the White House was leaked. Then, the order was reportedly put on pause to make room for a potential preemption clause in the National Defense Authorization Act. Then, the clause failed to make it into the Act.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Now, after various attempts to get federal preemption of state AI legislation through Congress have failed, the Trump administration appears to have fallen back on their executive order plan.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">While federal laws have the legal authority to preempt state legislation, executive orders don’t. As a result, the draft order we’ve seen attempts to take a carrot-and-stick approach to preventing states from creating their own AI regulations.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Some of the order’s tactics <a href="https://www.platformer.news/r/ec41672e?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>may be</u></a> illegal. The draft order suggests the attorney general’s office will sue states with AI regulations that  “unconstitutionally regulate interstate commerce.” This rests on legal arguments that current state AI regulations violate the Constitution’s dormant commerce clause because they make it too hard for AI companies to do business out of state. It’s unclear whether this argument will work for legislation like California’s SB 53, which the order mentions explicitly. (Transparency requirements do not obviously restrict interstate commerce.)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In addition, the order contains plans to withhold broadband funding from states. It’s not clear it’s legal to do so. Even if it were, some states may prefer to pass AI regulations anyway and simply lose out on the funding.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">With all these details up in the air, the Trump administration may actually be creating the regulatory chaos it says it's trying to prevent.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;"><strong style="font-weight: 700;">What people are saying:</strong> On <strong style="font-weight: 700;">X</strong>, White House AI and crypto czar <strong style="font-weight: 700;">David Sacks</strong> <a href="https://www.platformer.news/r/90e30c61?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>said that</u></a> the executive order will allow the government “to push back against the most onerous and excessive state regulation.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“At the same time, the Administration will continue to work with Congress to define a federal framework that can be enacted through legislation.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Sacks <a href="https://www.platformer.news/r/23fa8f9d?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">followed up</a> later in the day with promises to protect states' ability to pass regulations related to child safety and local infrastructure like data centers.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Florida Gov. <strong style="font-weight: 700;">Ron DeSantis</strong>, who recently proposed legislation on child safety and deepfakes in Florida, also <a href="https://www.platformer.news/r/da3b0eca?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>weighed in</u></a> on X. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“An executive order doesn’t/can’t preempt state legislative action,” DeSantis said.  “Congress could, theoretically, preempt states through legislation.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But DeSantis doesn’t think that’ll happen. “I doubt Congress has the votes to pass this because it is so unpopular with the public.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;"><strong style="font-weight: 700;">Ted Lieu </strong>(D-CA), <a href="https://www.platformer.news/r/be1665db?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>said</u></a>: “Once every 2 years I agree with Ron DeSantis. Paramount’s bid, led by CEO <strong style="font-weight: 700;">David Ellison</strong> and son of <strong style="font-weight: 700;">Oracle</strong> billionaire <strong style="font-weight: 700;">Larry Ellison</strong>, is backed by the Ellison family, <strong style="font-weight: 700;">Redbird Capital</strong> and commitments from banks, according to a <a href="https://www.platformer.news/r/d345d656?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>press release</u></a>.
